Experienced Mediator. Skilled Litigator.
In a divorce or legal separation, you and your spouse will be required to make challenging decisions about joint property. You will have to decide who gets the house, who will take the credit card debt, how your retirement funds will be divided and more.
In North Carolina, any property or debt acquired during the marriage is considered marital property. There are some exceptions to this law such as inheritances received during marriage. If you and your spouse are unable to divide your marital property on your own, the North Carolina courts will divide your property according to equitable distribution laws, which are based on several factors, including how long you have been married and the income of each spouse. Equitable distribution does not mean that your property will be divided 50-50. That's why it's in your favor to settle your property settlement disputes outside of the courtroom.
Our firm's founder, Charlene Edwards, is one of only two certified family financial mediators in the Harnett County area. Her experience in financial mediation and dispute resolution makes her uniquely qualified to assist spouses in coming to an agreement about property distribution. Not only is mediation faster and less costly than litigation, it also allows you and your spouse to remain in control of decisions made about your property.
If mediation is not an option, our firm's Harnett County property division attorneys are skilled in negotiating and litigating fair property settlements. We will advise you of all the options that are available to you and the financial implications of each. We will help you prepare and file a qualified domestic relations order (QDRO) to ensure that your retirement accounts are divided properly. Additionally, our firm has experience representing military service members in division of military pensions and other benefits.
We also can help spouses craft prenuptial and post-martial agreements that will account for any issues that could arise in the event of a divorce, including division of assets.
