In North Carolina, any property or debt acquired during the marriage is considered marital property. There are some exceptions to this law such as inheritances received during marriage. If you and your spouse are unable to divide your marital property on your own, the North Carolina courts will divide your property according to equitable distribution laws, which are based on several factors, including how long you have been married and the income of each spouse. Equitable distribution does not mean that your property will be divided 50-50. That's why it's in your favor to settle your property settlement disputes outside of the courtroom.
